1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

If you are using the Service on behalf of an organization (such as a real estate brokerage), you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

AI Realty Kit is an AI-powered platform that helps real estate professionals analyze home inspection reports, seller disclosures, and related property documents. The Service provides:

Document upload and storage
AI-powered analysis of inspection reports and disclosures
Extraction of findings with priority levels and cost estimates
Report generation and sharing with clients
Collaborative workspaces for client review
Chat-based document querying
Access from third-party AI assistants you connect, such as ChatGPT or Claude

3. User Accounts

To use the Service, you must sign in with a Google account or with an email address and password. You are responsible for:

Maintaining the security of your account credentials
All activity that occurs under your account
Notifying us immediately of any unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Acceptable Use

You agree not to:

Upload documents you do not have the right to share or analyze
Use the Service for any unlawful purpose
Attempt to gain unauthorized access to any part of the Service
Interfere with or disrupt the Service's infrastructure
Use automated tools to scrape, crawl, or extract data from the Service
Share your account access with unauthorized third parties
Upload malicious files, viruses, or harmful content
Misrepresent AI-generated analysis as professional inspection or legal advice

5. Your Content

You retain full ownership of all documents, files, and data you upload to the Service ("Your Content"). By uploading content, you grant us a limited, non-exclusive license to process, store, and analyze Your Content solely for the purpose of providing the Service to you.

We do not claim ownership of Your Content. We do not sell, share, or use Your Content for any purpose other than providing the Service, except as required by law.

You are responsible for ensuring you have the necessary rights and permissions to upload and share the documents you provide to the Service.

6. AI-Generated Content Disclaimer

The Service uses artificial intelligence to analyze documents and generate findings, cost estimates, priority assessments, and recommendations. This analysis is provided for informational purposes only and does not constitute professional advice.

Specifically:

AI-generated analysis is not a substitute for a professional home inspection
Cost estimates are approximate ranges based on AI analysis and may not reflect actual repair costs in your area
Priority assessments are automated suggestions and may not capture all relevant factors
AI may occasionally produce inaccurate, incomplete, or misleading results
Always obtain professional quotes from licensed contractors for actual repair costs
Consult with qualified professionals (inspectors, contractors, attorneys) before making decisions based on the Service's output

We are not responsible for decisions made based on AI-generated analysis. Users should independently verify all findings and recommendations.

7. Use Through Third-Party AI Assistants

You may connect the Service to a third-party AI assistant, such as ChatGPT, Claude, Claude Code, or Codex, and use it from there. When you do:

The assistant is provided by its own company under its own terms. We are not responsible for the assistant, and it may summarize, omit, or misstate the findings we return. The report on our website is the authoritative version of your findings.
Findings and cost ranges are AI-generated estimates based on your documents, as described in Section 6. They are not a professional inspection or a licensed professional's evaluation.
You are responsible for having the right to upload every document you send through an assistant, just as on our website, and for choosing the correct property for it.
You are responsible for activity by any assistant you connect to your account. You can disconnect it at any time in the assistant's settings, or ask us to revoke its access.
Where we offer a free analysis to new accounts, it covers one property per account (not per assistant), up to 5 documents and 150 pages, and may require a verified email address. We may change, limit, or withdraw the free analysis at any time, including for suspected abuse such as creating multiple accounts. A property already granted a free analysis keeps it.

8. Intellectual Property

The Service, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.

Reports generated by the Service using Your Content are yours to use, share, and distribute as you see fit.

9. Payment and Subscriptions

Certain features of the Service require a paid subscription. By subscribing, you agree to:

Pay the applicable fees as described on our Pricing page
Provide accurate and complete billing information
Authorize us to charge your payment method on a recurring basis

Payments are processed by Stripe. We do not store your credit card information directly. Subscription terms, cancellation policies, and refund eligibility are described on our Pricing page.

We reserve the right to change our pricing with reasonable notice. Price changes will not affect your current billing period.

10. Limitation of Liability

To the maximum extent permitted by applicable law, AI Realty Kit and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, data, or business opportunities
Damages resulting from reliance on AI-generated analysis
Costs of procuring substitute services
Errors, inaccuracies, or omissions in document analysis
Unauthorized access to or alteration of your data
Service interruptions or downtime

Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Indemnification

You agree to indemnify and hold harmless AI Realty Kit, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of a third party
Content you upload to the Service

12. Termination

You may stop using the Service at any time. You may request account deletion by contacting us at the email below, and we will delete your account and associated data within a reasonable timeframe.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ceases immediately. Sections regarding intellectual property, limitation of liability, indemnification, and governing law survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

For material changes that significantly affect your rights or obligations, we will make reasonable efforts to notify you via email or through the Service.
